I wish to stress that this amendment does not provide any defenses such as those found in title VII. Therefore. the amendment eliminates virtually all employer defenses against national origin claims that are available under title VII. I also wish to remind my colleagues in the Senate and our conferees working on a compromise SimpsonMazzoli bill that last year. as we considered immigration reform legislation. the Senate rejected this approach in the form of an amendment offered by Senators HART and LEVIN by a vote of 59 to 29. I commend the New York Times article to the attention of my colleagues and ask that the article be printed in the RECORD.
