Mr. Speaker. if the gentleman would yield. the answer is "Yes." The purpose and intent of this bill. and our understanding of it is that if an alien is subject to deportaton under section 241(a) (11) for a minor drug offense committed within the United States and is the subject of a waiver with respect to the offense under section 212 (h). as amended. the Attorney General could adjust the aliens status without requiring the alien to depart from the United States and to reenter if a visa number is immediately available. If none is currently available. the Attorney General should at his discretion delay deportation until one becomes available.
