A situation of extreme hardship. in my judgment. and the judgment of the supporters of this legislation. would be a situation in which close family relations were seperated. I would hope that that would be understood. Let me be absolutely clear. it is our intent that in the case of an alien who has committed a minor drug offense and whose immediate family includes citizens or permanent residents of the United States. the exclusion or deportation of the alien from the United States and consequent separation from these family members does constitute an "extreme hardship" within the meaning of section 212(h). as amended. In the committees application of its rules relating to "unusual hardship" to cases of private immigration legislation. we have consistently interpreted "hardship" to include such cases.
