A second amendment is adapted from a draft submitted to the House by Assistant Attorney General J. Stanley Pottinger. and recommended to us by the Civil Rights Commission. In a separate title based on the 15th amendment. it would amend the definition of "test or device" to cover Englishonly election materials for nonEnglish speaking groups that constitute at least 5 percent of the voting age population. In other words. a requirement that minority language groups understand Englishonly voting materials would be considered a literacy test. and thus trigger the present protections of the Voting Rights Act. My third amendment would gear its triggering formula to "language minorities" which would be defined as American Indian. Asian American.
