The provision that they shall not be admitted to bail is another and a distinct provision. A man may think he is entitled to the writ of habeas corpus. and he may be discharged entirely if he should prove that he is not a Chinese person or that he has a certificate of registration and therefore is not amenable to this provision of law. I do not consider this to be a criminal proceeding. It is a matter wherein the sovereignty of the United States undertakes to protect itself against the coming into the country and residence here of certain undesirable classes. and in doing that I suppose we have a right to say that when an examination is made by the courts and it is determined that they shall be deported they shall not be admitted to bail.
