I do not at this moment think of any other case where bail would be lawful or admissible. except on an application for habeas corpus in the discretion of the court. It may be issued by the Supreme Court returnable to a circuit court. Does not the Senator think the provision that a man shall. not be admitted to bail when he is in custody under an order of deportation is a provision that he shall not be admitted to bail on habeas corpus. and thereforeif a person is alleged to be subject to deportation when he is not. or if a person be arrested. and when the marshal. is. about to execute the order of deportation he carries his appeal to the Supreme Court of the United States. must he not remain in custody without bail if this. provision be carried into effect and be constitutional?
