And every person owning and cultivating land may. under the provisions of this section. enter other land lying eontiguous to his or her land. which shall not. with the land so already owned and cultivated. exceed in the aggregate 320 acres. SiEc. 3. Thatany person applying to enter desertland shall first make and subscribe before the proper officer. and file in the proper land office. an affidavit that he or she is the head of a family or is over twentyone years of age. is a citizen of the United States or has filed his or her declaration of intention to become such. as required by the naturalization laws. and a bona fide resident of the State or Territory in which the land applied for is situated. that such application is honestly and in good faith made for the purpose of reclaiming the same and adapting it to cultivation by irrigation. and not for the benefit of any other person. persons. corporation. or syndicate. and thathe or she will faithfully and honestly endeavor to comply with all the requirements of law as to irrigation. reclamation. and cultivation. necessary to acquire title to the land applied for. that he or she is not acting as agent of any person. corporation. or syndicate. in niaking such entry. nor in collusion with any person. corporation. or syndicate to give them the benefit of the entry or any part thereof. that he or she does not apply to enter the same for the purpose of speculation. but in good faith to reclaim tie same and adapt it tocultivation by irrigation for his or her own use. and that lie or she has not directly or indirectly mnde. and will not make any agreement or contract in aiy way or manner. with any person or persons. corporalion. or syndicate whatsoever. by which the title wh ich he or she omight acquire from the Government of the United States should inure in whole or in part to the benefit of any person. corporation. or syndicate except himself. or herself. and family. and upon filingsueh affidavit with the register or receiver on payment of $5 when the entry is of not more than 80 acre. and on paynmnemt of $10 when the entry is for more than 80 but not more than 160 acres. and oil payment of $t5 when the entry is for more than 160 but not more than 240 acres. and on payment of 120 when the entry is for more tha . 240 acres. he or she shall thereupon be permitted to enter the amount of land specified. SEc. 4. Thatatthetimeof filing the declaration hereinbefore required the party shall also file a map of said land. which shall exhibit a plan showing the mode of contemplated Irrigation. and which plan shall be sufficient to thoroughly irrigate and reclaim said land. and prepare it to raise ordinary agricultural crops. and shall also show the source of the water to be used for irrigation and reclamation.
