That every person who is qualified to make an entry of land under the homestead law shall be entitled to enter 20 acres. or a less quantity. of unappropriated desert public lands. to be located in a body. in conformity to the legal subdivisions of the public lands. And every person owning and cultivating land may. under the provisions of this section. entcrother land lying contiguous to his or her land. which shall not. with the land so already owned and cultivated. exceed in the aggregate 320 acres. That any person applying to enter desert land shall first make and subscribe before the proper officer. and file in the proper land officean affidavit thathe or she is the head of a family or is over twentyone years of age. is a citizen of the United States. or has tiled his or her declaration of intention to become such. as required by the naturalization laws. and a bona fide resident of the State or Territory in which the land applied for is situated. that such application is honestly and in good faith made for the purpose of reclaiming the same and adapting it to cultivation by irrigation. and not for the benefitof any other person. persons. corporation. or syndicate. and that he or she will faithfully and honestly endeavor to comply with all the requirements of law as to Irrigation. reclamation. and cultivation. necessary to acquire title to tle land applied for. that tie or she is not acting as agent of any person. corporation. or syndicate in making such entry. nor in colluslon with any person. corporation.or syndicate to give them the benefit of the entry or any part thereof. that lie or she does not apply to enter time same for the purpose of speculation. but in good faith to reclaim the same and adapt it to cultivation by irrigation for his or her own use. and that he or she tias not directly or indirectly made. and will not make. any agreement or contract. in any way or manner. with any person or persons. corporation. or syndicate whatsoever. by which the title which he or she might acquire from the Government of the United States should Inure in whole or in part to the benefit oh any person. corporation. or syndicate except himself. or herself. and family. and upon filing such affidavit with the register or receiver on payment of $5 when the entry is of not more than 80 acres. and on payment of $10 when the entry is for more than 80 but not more than 160 acres. and on payment of $15 when the entry is for more than 160 but not more than 240acres. and on payment of $20 when the entry is for more than 240 acres. he or she shall thereupon be permitted to enter te amount of land specified. That at the time of filing the declaration hereinbefore required. the party shall also file a map of said land. which shall exhibit a plan showing the mode of contemplated irrigation. and which plan shall be suilicient to thoroughly irrigateand reclaim said land. and prepare it to raise ordinary agricultural crops. and shall also show tise source of the water to be used for irrigation and recla. mation. Persons entering desert lands may associate together in the construetion of canals and ditches for irrigating and reclaiming the same. and may file a joint map or maps showing their plan of internal improvements.
