If we are going to get anything done. there has to be a consensus. The other justification the President is fond of using for his actions is the executive branchs ability to exercise prosecutorial discretion. but while the President does have the authority to decide when to prosecute or where to allocate resources. that authority is not unlimited. The Presidents actions with respect to immigration go far beyond prosecutorial discretion. Lawful prosecutorial discretion is exercised on a casebycase basis. Lawful prosecutorial discretion isnt excluding entire categories of individuals in a blanket fashion and telling them that going forward the law will be applied to them.
