President. we had testimony that one of the reasons a lot of people believe that to be the case is not that the jurists on the Ninth Circuit may be less competent than those in other circuits. but that is because of the overwhelming caseload. the circuit doesnt have the time to consider the cases that other circuits do but the use of the enbanc panel. instead of the full circuit. contributes to this problem. Mr. President. 20 percent of the country is in the Ninth Circuit. It is laden with immigration cases. It has too many cases per judge and. because of that. too many of the cases that need to be heard in a timely fashion are delayed. What our bill simply would do is to divide the Ninth Circuit up in a very fair manner.
