This resolution is based on two fundamental propositions. First. JacksonVanik conditions mostfavorednation status on the right to emigrate and. second. the United States should not make concessionary agreements with the Soviet Union where the Soviet Union is in breach of its contract to honor its firm commitments on the El AlAeroflot agreement to transport Soviet Jews to Israel. Mr. President. the provisions of JacksonVanik are plain as set forth in 19 United States Code 2432: "To assure the continued dedication of the United States to fundamental human rights". and then continuing. that a nation shall "Not be eligible" to receive "mostfavorednation treatment" where "there Is a denial of its citizens of the right and opportunity to emigrate." Mr. President. I believe that at the present time there is that denial because there are Jews in the Soviet Union who hold visas permitting them to leave the Soviet Union and to enter Israel. Since they have airline tickets 10 months away or so. they are in effect. being denied the right to emigrate. This is a very fundamental February 28. 1.990 breach because. given what is happening in the Soviet Union today. there is considerable evidence of virulent antisemitism. There is considerable talk about massive pogroms of Jews on May 5 and it is a matter of the utmost urgency.
