Session #101 · 1989–91

Speech #1010116798

Is narrowly defined in current law. By longstanding practice. many legal experts state that the administrations action providing a blanket waiver is subject to judicial challenge. And the presumption of continuous lawful presence in the United Statesa necessity for Chinese students whose visas may have lapsed since Juneis something on which. again. the Attorney General has little authority. As CRS puts it. there is "a serious question about the Attorney Generals authority to waive a statutory requirement for relief." The world will never forget the tragic events of last June 4 in Beijing and the courage and determination of the Chinese studentsand neither should the United States Senate. No tanks. no guns. no prison cells can long deny the day when democracy and human rights will finally come to China.
