That is all it says. It does not require the forms to be filled out. it only says if they have been filled out already. the employer may use that as a defense. The other point I think is important to know here is that if the employer finds out that the individual is an illegal alien. that this is not a conclusive defense. But the bottom line on this is whether or not you want to add an additional burden to the employers of America and make this process more cumbersome. more time consuming. more costly. and more unworkable. Basically. all the language of the bill says right now is that if these items have been checked by the State unemployment agency and if they have chosen to supply documentation. then that process does not have to be needlessly duplicated.
