The provision in this bill would allow the alien to live and work in the United States. just as he or she is allowed now. but would require that he April 8. 1.986 or she certify to the Government that the marriage is still valid 1 year later. If it is valid. that first year will be counted toward naturalization. This to me. Mr. President. is a sound and reasonable change to our current law. The bill also provides that the Commissioner has the discretion to waive the requirement this bill places on fiance(e) petitions if he is presented with an exceptional case. I have asked the General Accounting Office [GAO] to investigate how other countries issue spousal and fiance(e) visas and whether marriage fraud presents as big a problem to them. The results of this study should be available in May or June of this year and I am hopeful that the subcommittee can act after it receives the GAO report. There have been some suggestions that this bill include a provision which would not only require that both parties meet in person but that they also speak the same language.
