The JacksonVanik provisions were made a part of the Trade Act in an effort to make a statement in support of basic human rights: indeed. the U.S. Helsinki Watch Committee has stated: The spirit of the (JacksonVanik) amendment has been interpreted to include the human rights situation as a whole. Further. the amendment itself. now part of the Trade Act. states that it is "to assure the continued dedication of the United States to fundamental human rights * * " that products of nonmarket [Communist] countries are not to receive favorable MFN treatment if they have not complied with the very simple and basic tenets of that amendment regarding the right to emigrate. The law also contains a provision which would allow the President to ask for a waiver in cases where the Communist country does not comply with the simple and basic provisions of JacksonVanik. and yet the President wishes to grant the country MFN despite its noncompliance.
