We go through the following scenario: If the employer. despite these things. has violated the law and had his first strike at bat. the Attorney General still has to bring him in before he can prosecute him and advise him that he has violated the law. Then. and only then. if he violates it again. he is given his second strike. a $1.000 fine. And the third strike is a $2.000 fine. and then somewhere far down the road is the suggestion of a criminal penalty for someone who has repeatedly violated the law as to the hiring of undocumented aliens. It is only in these instances. these extreme instances. when an employer would be called on and subjected to a criminal penalty. and only after there has been some adjudication of guilt. I do not believe this puts an unreasonable burden on the employer who is acting in good faith.
