He was then formally denied the appeal to which he is entitled under Soviet law. During the trial one of the supposed pieces of "evidence" presented against him was testimony that he had transferred state secrets to Los Angeles Times reporter Robert Toth. These state secrets where not secrets at all. but rather the readily available names and addresses of other Soviet subjects who had been denied the right to emigrate on the grounds that they had been privy to classified state information. Shcharansky was clearly cited as the source of the information in the Los Angeles Times. Was this the activity of a "top secret" undercover agent for the CIA?
