If the administration develops more evidence of abuse in this area. the Congress will consider making responsive revisions. Until then. the law stands in its current form. On behalf of the conferees I would like to note that. even though guaranteed expedited service. certain destitute migrant households may encounter hardships as a result of other provisions already enacted which require the initial months benefits be prorated from the date of application. Current interim final regulations issued by the Department on September 4. 1981. provide destitute migrants applying late in a month only a few days benefits on an expedited basis. the next months allotment will not be issued until the first months circumstances are verified. Where migrants must seek such verification from outside the State. the issuance of the second months benefits may be unreasonably delayed. The conferees. therefore. direct the Department. when issuing final regulations on this matter. to assure that. when verification must be acquired from outside the State. destitute migrant households applying for expedited service in the second half of the month be provided with a reasonable opportunity to obtain such verification without a loss or delay in benefits. The conferees determined to limit restoration of benefits improperly denied by a State agency to a period 1 year prior to the receipt of a request for their restoration or discovery of their improper denial by the State. whichever occurs earlier. This provision. like all others in the bill where no other express provision contravenes. is to take effect upon such dates as the Secretary shall prescribe.
