My last amendment is one whose importance and impact grow daily. This amendment would prohibit illegal aliens from receiving legal assistance under the Legal Services Corporation Act. This restriction would be consistent with the Immigration and Nationality Act which guarantees that those persons whose legal entry into this country is being questioned would be granted the privilege of counsel but at no expense to the Government. Mr. President. my amendment is necessary to erase a lot of the ambiguity which has arisen under the existing legal services language which restricts assistance to those who are known illegal aliens in violation of the Immigration and Nationality Act. Known illegal aliens have been defined by the Corporation to be those who are judged illegal by a court of law or immigration judge. As a result. the Legal Services Corporation is free to represent any and all other aliens. even those who have deportation or exclusion proceedings pending against them. What my amendment does is to bring the Legal Services Corporation Act more in line with the prohibitions of the Immigration and Nationality Act by specifying just which resident aliens would be eligible to receive legal assistance from a legal services agency. All other aliens would then be ineligible for legal services assistance. This amendment. in my opinion. is necessary for clarity but also for practical reasons.
