It simply says. let the courts have some discretion. We let courts have discretion with respect to the punishment of criminals on their first offense. even when they use a firearm in the commission of a felony. Let us. for heavens sake. give the court and the jury some discretion in this kind of case. where we are dealing with a U.S. citizen. potentially. or a refugee who may not be a citizen but is trying to get out from a totalitarian government. It seems to me that under those circumstances the court or the jury ought to have some discretion. I would certainly hope the manager of the bill would accept that proposition.
