The United States has recognized the right of political asylum in its rich heritage of accepting the downtrodden of the world as well as in its constitutional guarantees of personal liberty and due process of law. In addition. the United States has signed the UN Covenant on the Status of Refugees and Is obliged by its No. 33 to accept a refugee whose life or liberty might be threatened for racial. religious. national. or political reasons. Regrettably. these commitments of the United States were not realized in the Kudirka case.
