There was not a scintilla of testimony that Spanishspeaking people had been discriminated against intentionally under this law. but the court held that regardless of whether or not the New York literacy test was a valid law under the first section of the 14th amendment. the court would have to uphold that law beCXVIII284--Part 4 cause this would give the Puerto Ricans political power. and their political power would enable them to keep New York State thereafter from depriving them of the equal protection of the laws.
