H.R. 9045 eliminates an important restriction in the present status on criminal penalties for violations of Presidental travel bans. As I pointed out earlier. the Court of Appeals for the Fifth Circuit. in the Worthy decision. stated that the President has the clear authority to impose travel restrictions not only in time of war. but at all times. The Immigration and Nationality Act. however. provides penalties only for violations of restrictions imposed in time of war or national emergency. Thus. the Congress. to date. has failed to fully support. by statute. the Presidents authority in this area. I believe that as long as the courts have consistently held that he has the power to impose such bans at all times.
