Mr. President. the tax itself is wide open to abuse. The only reason evidence is not more weighty in this area Is that plainly other methods have been more convenient to date. such as literacy tests and other devices that we will be lifting by the proposed legislation. For example. a proffer of the tax may be refused. misleading or incorrect information as to the necessity or time of payment may be rendered to citizens. tax receipts or exemption certificates may be withheld on a discriminatory basis. or receipts may be backdated to make them timely for whites but not for nonwhites. I should like to cite five cases which have been brought. or which are in process of being brought. by the Government in this area. simply as a method of describing the kinds of abuses which have been found or alleged in the application of the tax.
