In the light of the past history of the committee. the witnesses had adequate justification for their objections to testifying in secret. The committee has provided no factual basis for its insistence that the witnesses testify in secret. (C) The stated subject matter under investigation was not within the jurisdiction of the Committee on UnAmerican Activities. All matters relating to immigration are vested in the jurisdiction of the House Judiciary Committee. and specifically its Subcommittee on Immigration and Naturalization. rule II. paragraph 12(b) of the House rules. And under the terms of section 136 of the Legislative Reorganization Act. 2 U.S.C. 190d. the House Judiciary Committee is charged with the responsibility of watching over the execution of the Immigration and Nationality Act by the executive branch. Accordingly. questions arising from the administration of that act. and its proposed revision or amendment. did not fall within the jurisdiction of the Committee on UnAmerican Activities. Indeed. under the provisions of 8 U.S.C. 1182(d) (6). the Attorney General submitted to Congress a detailed report of his action in admitting Professor Yasui.
