In the first place. with respect to what the proposed statute provides. it would create only a rebuttable presumption of literacy based upon a certificate of a sixthgrade education. It does not absolutely preclude the State from demonstrating that the holder of that sixthgrade voting certificate is unable to pass a literacy test which is administered in a nondiscriminatory way. So under the proposed statute. the Federal Government would not be dictating the qualifications for electors. It would merely erect a safeguard to prevent electors from being discriminated against by strange applications of the State requirements. With respect to the other issue relating to South Carolina in the Civil Rights Commission report.
