Committee on the Judiciary. and ordered to be printed in the RECORD. as follows: Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled. That section 328(b) of the Immigration and Nationality Act (8 U.S.C. 1439) is hereby amended (1) by striking the period at the end of paragraph (3) and inserting in lieu thereof a semicolon. and (2) by adding at the end thereof the following new paragraph: "(4) the petitioner may be naturalized without having been lawfully admitted for permanent residence. if (A) at any time subsequent to enlistment or induction. the petitioner shall have entered the United States pursuant to official orders of the Armed Forces of the United States. and (B) the petitioner. unless ineligible. shall have reenlisted in the Armed Forces of the United States within five years after the date of expiration of the original term of service for which the petitioner had enlisted or was inducted." SEC. 2. Section 3253(c) of title 10. United States Code. is hereby amended to read as follows: "(c) In time of peace. no person may be accepted for original enlistment in the Army unless"(1)" he is a citizen of the United States. or "(2) he has been lawfully admitted to the United States for permanent residence under the applicable provisions of the Immigration and Nationality Act. or "(3) he has been inducted into the Army and enlists on or before the date of the expiration of the term of service for which he was inducted. or within any period of five years immediately succeeding such date if he has resided continuously in the United States during such period."
