Session #85 · 1957–59

Speech #850023562

If the Supreme Court of the United States decides that 1 year is the maximum sentence which can be given to this racketeer for his flagrant violation of the Federal incometax laws. then I think a review of the decisions which have been made in connection with many other individuals should also be reviewed. For 30 years the Government and some Federal courts have been coddling this racketeer. and there are many people who are beginning to ask the question as to why they should be required to pay Federal income taxes if the members of the underworld and other individuals through some technicality or loophole in the law can escape prosecution or have their cases dismissed with nominal sentences or fines. To further complicate the understanding of this case. at the same time the courts are bending over backward to be lenient with this racketeer. the Department of Justice has supposedly been attempting through the courts to have Costello deported as an undesirable alien and one who obtained his citizenship illegally. I respect and will protect the right of any American citizen to defend himself in the courts against any charge and have consistently refrained from interfering with or criticizing the decisions of the courts. but the kidglove manner in which the courts have handled the case of this and other racketeers deserves some comment. and I am sure this decision is raising a lot of questions in the minds of many lawabiding citizens. I shall not attempt to review the tax evading history of Frank Costello. but I do feel that this case is of such importance that I shall incorporate in the RECORD here today a series of reports and articles showing the chronological order of the handling of this case.
