This is a part of the trend. as I said before. in many cases. as in the Interstate Commerce Commission. It is dictated by considerations of necessity. and it would be impossible for the judiciary to go into the inquiries. profound and complicated. that are made by the Interstate Commerce Commission. In the matter of excluding aliens it may be desirable. but I doubt. from my experience as Solicitor General. whether this arbitrary right on the part of the Immigration Commission on questions of fact ought to be as it undoubtedly is under the law. But let us not extend something that diminishes the prestige of the courts. that robs them of what is a judicial function. and that turns over to a bureau such absolute power over property and property rights. a power exercised too often in the spirit with which the great poet said: But man. proud manI Drest in a little brief authority.Most Ignorant of what hes most assured.
