Section 9 of Article I of the Constitution with reference to Immigration provides: . The migration or Importation of such persons as any of the States now existing shall think proper to admitSo that there the word "persons" refers to and Includes immigrants. I also call attention to that portion of the Constitutio which saysRepresentatives and direct taxes shall be apportioned among the several States which may be included within this Union. according to their respective members. which shall be determined by adding to the whole number of free personsAnd so forth. But it expressly excludes Indians not taxed. Where the law or the Constitution contains an express exclusion. can others be excluded by inference?
