Chairman. I rise in opposition to the amendment. Section 23 puts the burden of proof upon the alien "in any proceeding under the immigration laws." as to both his entry and remaining in the United States. The gentleman from Ohio moves to amend by striking out section 23 and inserting in lieu a provision which retains only the provision as applied to the right to enter. His reasons are that the provision as drawn is repugnant to all principles of American jurisprudence. It must be borne in mind that this pertains to entry or deportation only. There Is no question of criminal guilt to be determined. It Is only the right first to enter and then to remain.
