The first -section. of :that 1nw -simply declared that certain kinds of aliens should not be: admitted. .and section 8 thereof provided: That the Secretary.of the Treasury may rescibe rules -for the inspection along the borders of Canada. -British -Columbia. and Mexico .so as not to obstruct or unnecessarily delay. Impede. or annoy passengers in the ordinary travelbetween said countries. etc. The right of the Immigration Commissioner .under appointment .by ithe-:Secretary of .the Treasury to enforce certain rules and :regulations which had been promulgated. based upon that .law. -was !.challenged. iIn the course of the opinion on this point the court after first quoting paragraph 18 of section 8 of the Constitution. said: The. supervision of the admission of aliens into the United States may be Intrusted by Congress either to the Department of State. harying the general management of foreign relations. or to the Department of the Treasury. charged with the enforcement of the laws regulating foreign commerce. and Congress has often passed acts forbidding the immigration of particular classes of foreigners and has committed the execution of these acts to the Secretary of the Treasury. to collectors of customs. and inspectors acting under their authority. So in the foodcontrol bill. to which I havebeen referring. it is proposed by Congress to prohibit preventable waste or deterioration of foodstuffs or to prevent the hoarding of the same. or discrimnatory. unfair. or deceptive methods in the handling. of the same. to do anything which is necessary to conserve the foodstuffs of the country and fixing a penalty for the violation of these inhibitions but of necessity leaving to the President the making of such rules and regulations. as shall be necessary for carrying out in the most effective way the will of Congress thus expressed. I can not believe that in doing -this we in any sense transcend our authority.
