In that same year Mr. Kent. in his Commentaries. which were published from 1826 to 1830. declared the general rule maintained by the United States to be the rule of the common law of England of indefeasible allegiance. So. when this trety was made and we gave our express recognition of the right of the Emperor of Russia to make laws to prevent the emigration of his subjects. it was a treaty between two powers both of which maintained that no subject or citizen of theirs could ever emigrate to the other country and become a citizen of the other country without the express assent of his uiative land. That. sir. was the universal doctrine of the civilized world at that time. We held to that doctrine for many years. until. in 1848.
