I hope it will not be considered hypertechnical upon my part if I allude to what I consider the unconstitutional nature of this provision. It is impossible for me. whatever view some of my colleagues who stand in the same position may take. to support this measure with that clause as it was reported from the committee. The fourteenth amendment of the Constitution of the United States provides that all persons born or naturalized in the United States and subject to its jurisdiction shall be citizens. If the inhabitantsChinamen or not Chinamenof the Philippine Islands are in the United States. they are unquestionably subject to our jurisdiction. and whatever may be said of the adults. their children born in the jurisdiction of the United States and in the United States are certainly citizens under the provision of the fourteenth amendment.
