Again. present law and the version of this bill that comes to us from the Senate both provide that the Department of Labor certifies. upon application from an employer. the use of H2 workers for a certain period of time. The Department of Labor should measure the need for workers and how long they should stay in relationship to a certain job. What the Agriculture Committee is saying in this particular amendment is that the length of the stay of the H2 worker himself is another matter. and that should remain. as it has through the years. in the hands of the Immigration and Naturalization Service. They are the experts on this. They have always been responsible for the length of stay. as far as I know. in all of the nonimmigrant programs that exist: whether you are a student or a citizen of some other country and here for some purpose. the INS has always determined length of stay.
