Anti it is further provided that no fine. penalty. or judgmeet recovered by the United States under tbo provisions of the act to which this act is an amendment. or which may hereafter be recovered by the United States tinder this act. or the act to which this act Is amendatory. shall by any oflcer or agent of the United States be compromised for any sam of money less than the niountof money claimed or recovered ior the violation thereof. SEC. 3. That the master of any vessel who shall (knowingly) bring within the United State.4. on any vessel. or who shall land or permit to be landed from his vessel. from any foretg port or place. any alien laborer. mechanic. or artisan. who. previous to emliarking on such vessel. had entered Into contract or agreement. poarol or special. express or implied. to perform labor or service in the United States. shall be deemed guilty of a misdemeanor. and on conviction thereof shall pay a fine of not more than $500 for each and every such alien laborer. mechanic. or artisan so brought or landed as aforesaid. and may also be imprisoned for a term not exceeding six months. and shall return such alien to the port at which he embarked. and the above fine shall be a lien upon such vessel. and such vessel shall not have clearance froni any port of the United States until such fine ispaid. (The fact of such bringing or landing shall be printaft ic evidence of such knowledge.) SEC. 4. That it shall not be lawful for any person. persons. orcorporaton to encourage any alien laborer. meelanic. or artisan to migrate from any foreign country to the United States. by promise of employment. through advertisemeil or otherwise. and any such alien who shall thus be encouraged to immigrate to the United States. or who shall be a party to a contract prohibited by section I of this act. shall not be permitted to remain. but shall be returned to the port front whence lie sailed. and the expense incurred by the United States in the enforcement of this section may be collected froni the person. persons. or corporation who has thus encouraged the immigratio of the alien. by suit in the proper United States circuit court. and all such encouragement of immigration by promise of employment. tliroiigiadvertismnment or otherwise. shall be construed as a violation of section 1 of thisact. and shall subject any person. persos. or corporation so encouraging tie Immigration to the penalties provided In section 2 of this act. SEc. 5. That nothing in this act shall be so construed as to prevent any cliizei or subject of any foreign country temporarily residing in the United States. in any private or official capacity. front engaging. under contract or otherwise. persons not residents of the United States to act as private secretary or household domestics for such foreigner temporarily residing in the United States as aforesaid. nor shall this act be so construed as to prevent any person. persons. or corporation from engaging. under contract or otherwise. skilled workmen in foreign countries to perform labor In the United States in or upon any new Indtistry not at present established in the United States: Provided.
