If there is to be a discrimination made. it ought to be made in favor of the settler by the Government of the United States. When the trains were crossing the plains. as they got to Fort Kearney. the order was that they .should collect together in bodies of one hundred men. keeping the wagons together. and selecting an officer who would control them. and if they did not do this the Army said it would compel them to do it by military authority. Every man who freighted and every man who emigrated across the plains during those days was put under the control of military authority from the time he reached Fort Kearney until he passed the region where the Indians depredated. Those men are entitled to consideration. they are entitled to be dealt with on the -same rule of justice. They were the men who built up the mining communities of Colorado. the constituents of my friend from Colorado.
