The amount being invested. the accumulations were also to be reinvested. until the fund came to a very considerable sum. Afterward. some time perhaps between 1850 and 1860. a portion of that fond was invested in a class of securities not contemplated by the trust. that were noninterestbearing. and it is held by the Department of the Interior and also by the AttorneyGeneral to have been an improper investment of this fund. and therefore the trustee should make good to the ward this fund. Another portion of the fund was. diverted and paid. not to the orphans of the Creek Nation. but to the loyal refugees. which the Government of the United States had no right to do as trustee. These diversions. under the interpretations of the Secretary of the Interior and also the opinion of the AttorneyGeneral. should be made good by the United States to the orphans or their heirs. These two funds Srovided for in the bill amount. one to $176.755.97 and the other to 69.96.68.
