I should be glad to know upon what principle of interational law it is that a tattm which simply regulates the number of persons that on a particnlar voyage of a ship shall be brought into the United States has relation to any treaty of tme United Statesthat low exists or that is likely to exist. The treaty of she United States with China does not provide that there shall be nlimited passengers of the Chinese uation oi any particular ship of the United States or any other state or country. It provides for free emigration from both countries. or rather for the free equal right of denienship to the subjects and citizens of each country who happen to e in the other. That is the Substance of the treaty. so that woehave. the treaty notwithstanding. exactly the same power to regulate tre number of passongers and the knds of merchandise to be carried upon ships vhich are to be brought into our porte that we had without any treaty at all That is purely and exclusively a regulation of commerce.
