I think so. because suppose the treaty. instead of the fifth and sixth articles. should containa provision that the United States reserved to itself the right to pass measures to restrict the immigration of Chinese to our shores. then it could pass a law which would controlthe inmberthat shouldeomein any one ship. limitit toone. two. or one hundred as wo pleased. By the treaty we are now shut out from the right to legislate on this matter in a restrictive form. as I concei ve. I do not think that such a law would stand the test of the Supreme Court. even if passed by Congress under the clause of the Constitution authorizing the regulation of commerce. because it would interfere with a treaty which is the supreme law of the land.
