Session #110 · 2007–09

Speech #1100143348

The second provision of the bill provides that foreign aid would be conditioned on countries accepting back their native citizens under the circumstances which I have just described. The United States has a tremendous foreign aid program where allocations are made for a variety of what we consider to be in our national interest or in humanitarian interest. Here again we have a potentially effective tool for dealing with countries who refuse to accept back their own citizens where they have been ordered deported by the United States. In analyzing the problem further. no matter what we do under these circumstances. it is not possible to compel all foreign countries to accept their nationals back when they are subject to deportation. We are currently examining the possibilities of having some additional detention. Candidly. it is difficult to structure consistent with constitutional rights. which apply to these individuals. and consistent with due process of law.
