In the Fieldcrest Cannon case. workers at a factory in North Carolina sought an election to vote on union representation. To discourage its employees from voting for the union. the company fired 10 employees who had vocally supported the union. The employer threatened reprisal against other employees who had voted for the union and threatened that immigrant workers would be deported or sent to prison if they voted for the union. The union lost the election in August of 1991. Although workers filed an unfair labor practice case with the NLRB. the administrative law judge did not decide the case until 3 years later. in 1994. and his order was not enforced by the Fourth Circuit until 1996a lapse of some 5 years.
