First of all. you have to work with the other country to ensure they can be removed to the other country. and then you have to keep them in custody until they can be removed. In the meantime. if they want to make a case for asylum. they may do so. and the only standard is the usual standard of credible fear. So lets not labor under the assumption that this outlying case. this person who will be subject to abuse if the person is returned home. cant make an asylum claim. You can. and it is resolved just like the other asylum claims are resolved: If you can establish a credible fear so that you are put in a separate category over here. and you are not removed to your home country. But what about those who do not? Today there arent sufficient detention spaces for these individuals. and so many of them are simply asked to report back in a few days and they dont show up. obviously.
