The statute is carefully constructed to protect American workers. taking away any incentives for employers to hire foreign workers. For example. the employees must be paid the higher of what is the actual wage paid to other employees with the same skill or the prevailing wage rate for that job. So the law requires the employer to pay the immigrants the same as they would pay somebody else. And the employers must provide the same working conditions and benefits that are available for similar jobs. You dont have a class of immigrant workers who are being taken advantage of. The employers must provide insurance if the State workers compensation doesnt cover all of these workers. So you have a situation where there are no incentives to lose American jobs.
