During the period of delay. events may change the aliens chances of staying in the country. Those changes may be personal. such as a marriage to a U.S. citizen or the birth of a child. or any number of other conditions that might affect their removability. Or those changes may be political. such as change in country conditions in the aliens home country. or legislative and administrative. such as immigration reform in the country. giving the alien new hopes to remain here. Even if the appeal lacks all merit. the backlog of cases in the circuit court provides an incentive to appeal by almost guaranteeing a delay in deportation. now on an average of 27 months. What I would say to my colleagues is. If we are going to do somethingand we shouldwe have to confront the problem of those who are here illegally and handle that in a humane and fair and decent way.
