It has nothing to do with what their status was before. 245(1) has nothing to do with a stay of deportation or a defense against deportation. An individual who is in this country illegally can be deported at any time. and nothing about 245(1) provides a defense or a stay of that deportation. And 245(1) does not allow any single individual to cut ahead of anyone else. It only applies when their number comes up and. as the gentlewoman from Florida has mentioned. it only involves where they actually make their status adjustment.
