The answer is in order to vindicate the purposes of the Federal statute. to punish the employer. I understand. But it seems to me that you must balance the other interests. namely in the immigration laws of the United States. Because to order an employer to pay somebody who is not working but had been discharged from work at a time when that person was not even legally in the country is to ask the employer to violate the immigration laws of the United States. to pay them when they should not have been here. when it would have been an illegal act for that employer to have hired them. It is an absurdity which should be corrected. So how do we punish the employer?
