And then. just in case the Beijing leadership didnt get the message that the United States would ignore the killings. repression. and continued persecution of dissenters. the administration called for a renewal of mostfavorednation status for the Peoples Republic of China in June. Section 402 of the Trade Act. also known as the JacksonVanik amendment. permits the extension of MFN only to nonmarket economies that do not restrict emigration. Clearly. China does not meet that test. Emigration and travel outside of China have always been tightly restricted by the Chinese authorities. and have become substantially more restrictive since the crackdown last year. Passports and exit permits are routinely denied. particularly if there is any evidence. even a false confession extracted under duress. of participation in the democracy movement. Students must now work for 5 years before they may gain permission to study abroad. Anyone caught trying to leave the country may be sentenced to a reeducation camp. In view of the lack of progress on human rights in China over the past 1 V2 years. it is also difficult for the administration to argue that a waiver of the JacksonVanik emigration requirement will lead to the achievement of freedom of emigration objectives. Weve already tried this approach. and it has failed. We should not permit privileged trading status for the Peoples Republic of China until the thousands of political prisoners are unconditionally released. freedom of emigration is granted. forced labor is halted. the de facto martial law in Tibet is lifted. and religious and political persecution is stopped. To do any less would be to condone the continued egregious human rights violations in China. and to further delay any progress toward reform. liberalization. freedom. and democracy for the people of that country.
