That if nondiscriminatory treatment is extended to the Peoples Republic of China for a 12month period pursuant to the recommendation of the President that was submitted to Congress on May 24. 1990. then. notwithstandIng any other provision of law. such treatment shall expire on the first day of the 7th month of such 12month period unless the President certifies to the Congress before such first day that he has determined that(1) the Government of the Peoples Republic of China has. with respect to human rights(A) released all demonstrators and dissidents imprisoned in China and Tibet because of their political or religious views and publicly disclosed their names. (B) granted permission for International human rights groups to investigate human rights conditions within China and Tibet. including visiting prisons to account for political prisoners in China and Tibet. (C) ended the intimidation and harassment. In the United States. China. and Tibet. of students and others who are involved In. or sympathetic to. the prodemocracy demonstrations of 1989. and (D) ended interference with the free exchange of information. including interference with mall and Voice of America broadcasts to China. and (2) the Government of the Peoples Republic of China is engaging in active and constructive negotiations regarding Tibet with representatives of the Dalai Lama in order to reach a fair and reasonable settlement of the conflict in Tibet: and (3) there is freedom of emigration from China and Tibet.
