Session #101 · 1989–91

Speech #1010099327

I yield myself such time as I may consume. The gentleman from Colorado [Mr. HEFLEYJ quite understandably does not know the details of how immigration law is administered in this country. The reason that the action by Attorney General Meese has been ineffective is that it was not done in an effective fashion. It is a memo to the Commissioner of INS. The Commissioner of INS is not the immigration judge. Therefore. a memo to the Commissioner does not bind the immigration judges. The problem is that the Attorney General did not issue a regulation. The Attorney General is superior to the immigration judges. He appoints them. Anything they do can be reviewed by him.
